Pricing and Payment:

Prices throughout the website are quoted in Indian Rupees (INR). Payment can only be accepted in this currency.  Prices include taxes. Customers buying from overseas will be charged in their local currency equivalent to prices in INR. The courier and delivery charges will be applicable while checking out according to the country of shipping.

 
Notices:

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent by email to our contact address at thepopulor@gmail.com and all notices from us to you will be displayed on our website from time to time and we suggest that you check on regular basis.

 
Your Account:

In consideration of your use of the Site, you represent that you are of legal age to form a binding contract with The Populor and are not a person barred from receiving services under the laws as applicable in India. You also agree to provide true, accurate, current and complete information about yourself as prompted by the Site's registration form. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof). If you use the Site, you are responsible for maintaining the confidentiality of your account and password including cases when it is being used by any of your family members, friends or relatives, whether a minor or an adult. Liability:

If you do not receive goods ordered by you within 7 working days of the date on which you ordered them, we shall have no liability to you unless you notify us by email or telephone at our contact address of the problem within 14 days of the date on which you ordered the goods. If you notify us of a problem under this condition, our only obligation will be, at your option either:

1.1 to make good any shortage or non-delivery; or
1.2 to replace any goods that are damaged or defective; or
1.3 to refund to you the amount paid by you for the goods in question.

2. Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the clause mentioned above.
3. You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our website. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

 
Promotions:

The Populor occasionally releases promotion codes. The best way to be the first to know about any offers or sale events is to subscribe to our emails. To use a promotion code, please enter the code in the box provided on the basket page, click 'Redeem' and the discount will be applied to your shopping basket. If you have any problems at all redeeming your code, please contact our office via phone or write to us at thepopulor@gmail.com

Unless advised that your offer will automatically be applied to your basket, you must enter the promotion code during the checkout process when placing your order online, otherwise the discount will not be applied to your order.

2. Promotion codes are only valid on full price items and exclude sale items, gift wrap, Gift Cards, special orders.
3. Only one code can be used per transaction.
4. All offers are subject to stock availability and are subject to change at any time.
5. Codes are non-transferrable and no cash alternative is available.
6. Any promotion code offered on the website is valid only for use against a purchase made via the website, unless otherwise stated.
7. If returning an item from an order purchased with a promotion code applied, then the same discount will be applied to each item of your order that you return. Further, any free promotional gift given with an order must also be returned if you are returning the item(s) to which the gift is related
    

Equipment:

The User shall be responsible for obtaining and maintaining telephone, computer hardware and other equipment needed for access to and use of the Site and all charges related thereto. The Company shall not be liable for any damages to the User's equipment resulting from the use of the Site.

While we have made every effort to display as accurately as possible the colours of the products that appear on the Site, we cannot guarantee that your monitor or screen’s display of any colour will be completely accurate, as computer monitors and screens of electronic devices vary.

Online Payment:

All payments onwww.thepopulor.comare securely processed. We accept most major credit and debit cards including Visa, MasterCard and American Express. We also accept bank transfers upon special request. We will ensure confirmation of ordered item(s), availability and shipping before processing your order transaction. You will be advised by e-mail or phone if we are unable to complete your order.

 
Cancelation and Changes By Customers:

If you wish to cancel or modify your order, please contact via email to thepopulor@gmail.com. The Company shall make all efforts to accommodate the request. However, once an order has been submitted we cannot guarantee the purchase can be cancelled or modified. Once you have received your online order, if it is the incorrect product or found to be damaged please contact us within 3 days of receipt and we will arrange for collection and www.thepopulor.com will bear the expenses. Customer will be issued a refund within 48 hours only after the parcel has arrived at The Populor studio in original shape, form and original packaging. The customer agrees to not dispute the timeline of the parcel return time as a third party shipment company is involved and each return parcel has different timeline due to circumstances outside of The Populor's control. The customer agrees not to dispute the decision made by the Company and accept the decision regarding the cancellation. Order cancellations can not be based on the basis of colour and look discrepencies.

 
Cancellation by www.thepopulor.com:

We reserve the right to cancel the contract between you and us if:

We have insufficient stock to deliver the goods you have ordered;
we do not deliver to your area; or one or more of the items you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.

If we do cancel your contract we will notify you by email or by telephone, and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Events Beyond Our Control:

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, third party shipment delays, strikes, lockouts and other industrial or political disputes, breakdown of systems or network access, flood, fire, explosion or accident or Act of God.

The place of arbitration shall be Mumbai, Maharashtra. The Arbitration & Conciliation Act, 1996, shall govern the arbitration proceedings. The arbitration proceedings shall be in the English language.

Governing Law

This Agreement, and the Privacy Policy or the documents they incorporate by reference shall be governed and construed in accordance with the laws of India, with exclusive jurisdiction conferred on the courts at Thane, Maharashtra.
